Terms of Service

1. Agreement to Terms

By accessing or using Katie ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Katie is operated by Katie App Pty Ltd ("we", "us", or "our"), registered in New South Wales, Australia.

2. Description of Service

Katie is a voice-first case management platform designed for special education teachers in Australia. The Service allows educators to:

• Record voice notes and have them automatically transcribed
• Extract structured data from transcriptions using AI
• Manage student caseloads and case notes
• Generate compliance reports for NCCD and NESA requirements
• Export data for audit purposes

3. Subscription Plans and Pricing

3.1 Free Trial

New users may be eligible for a free trial period. Trial terms and duration will be specified at signup. At the end of the trial, you must subscribe to continue using the Service.

3.2 Subscription Options

All prices are in Australian Dollars (AUD) and include GST where applicable.

3.3 Payment Processing

Payments are processed securely through Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel. Stripe's terms of service and privacy policy apply to payment processing.

3.4 Subscription Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled. You will be charged the then-current subscription rate at renewal. We will notify you of any price changes at least 30 days before they take effect.

3.5 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

• You retain access until the end of your current billing period
• No refunds are provided for partial billing periods
• Your data remains accessible in read-only mode for 30 days
• After 30 days, your account and all associated data will be permanently deleted

3.6 Refunds

We offer a 14-day money-back guarantee for new subscribers. If you are not satisfied with the Service within the first 14 days of your initial subscription, contact us for a full refund. After 14 days, subscriptions are non-refundable except where required by Australian Consumer Law.

4. Account Registration

4.1 Eligibility

You must be at least 18 years old and a qualified educator to use Katie. By creating an account, you represent that you have the authority to enter student information as part of your professional duties.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must immediately notify us of any unauthorised use or security breach.

5. Acceptable Use

You agree to use Katie only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service for any purpose other than legitimate educational case management
• Enter false, misleading, or fraudulent information
• Share your account credentials with others
• Attempt to access other users' data or circumvent security measures
• Use automated systems to access the Service without permission
• Interfere with or disrupt the Service or its infrastructure
• Violate any applicable laws or regulations, including privacy laws

6. Data Ownership and Responsibility

6.1 Your Data

You retain all ownership rights to the data you enter into Katie, including student information and case notes. We claim no intellectual property rights over your content.

6.2 Your Responsibilities

You are solely responsible for:

• Ensuring you have appropriate consent or authority to enter student information
• The accuracy and appropriateness of all content you create
• Compliance with your school's policies and applicable education regulations
• Maintaining appropriate backups of critical data

6.3 Our License

You grant us a limited license to process your data solely to provide the Service, including transcription, AI analysis, and storage. This license terminates when you delete your account.

7. AI-Generated Content

Katie uses artificial intelligence to transcribe audio and extract structured data. While we strive for accuracy:

• AI-generated content may contain errors or inaccuracies
• You are responsible for reviewing and verifying all AI-generated content
• Notes flagged for review should be checked before use in official documentation
• We do not guarantee the accuracy of transcriptions or extracted data

8. Service Availability

We aim to provide reliable access to Katie but do not guarantee uninterrupted service. We may temporarily suspend access for maintenance, updates, or circumstances beyond our control. We will provide reasonable notice of planned maintenance where possible.

9. Intellectual Property

The Katie platform, including its design, features, and underlying technology, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.

10. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim
• We are not liable for decisions made based on information in the Service

Nothing in these Terms excludes or limits liability that cannot be excluded under Australian Consumer Law.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service immediately if you:

• Breach these Terms
• Fail to pay subscription fees
• Engage in fraudulent or illegal activity
• Pose a security risk to the Service or other users

Upon termination, your right to use the Service ceases immediately. Sections relating to ownership, liability, and disputes survive termination.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service at least 30 days before they take effect. Continued use after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales, and you consent to their exclusive jurisdiction.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect.
